1. What these rules cover
These rules apply to everything you publish, upload, send or set up through Parichy: Smart Profile content and links, forms and uploads, artwork and text for printed hardware, redirect rules, AI assistant settings, and how you use the Website. They are the rules and regulations and user agreement that Procure Services publishes as required by India’s Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and they are part of our Terms & Conditions.
2. Content you must not publish
You must not host, display, upload, modify, publish, transmit, store, update or share anything that:
- belongs to another person and to which you have no right;
- is obscene, pornographic, paedophilic, invasive of another person’s privacy (including bodily privacy), or insulting or harassing on the basis of gender;
- is defamatory, or racially or ethnically objectionable, or promotes hatred, violence, terrorism or self-harm;
- relates to or encourages money laundering or gambling, or otherwise breaks any law in force in India;
- is harmful to children;
- infringes any patent, trademark, copyright or other proprietary right;
- deceives or misleads people about where it comes from, or is patently false, untrue or misleading and intended to mislead, or is a scam, phishing or a fake review or testimonial;
- impersonates another person or organisation;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States or public order, or incites an offence or interferes with the investigation of one;
- offers illegal goods or services — weapons, drugs, counterfeit goods, stolen data — or anything that needs a licence you do not hold;
- contains software viruses or any other code, file or program designed to interrupt, destroy or limit the working of a computer resource.
3. Conduct you must not engage in
- Impersonating a person or organisation, or misrepresenting who you are or who you work for — for example pretending to be an official, a bank or a licensed professional.
- Using redirects (including dynamic redirect rules), QR codes or NFC links to send people to phishing, malware or deceptive pages, or to hide where they lead.
- Collecting visitors’ personal information without telling them, without a lawful basis or by deception, or using lead capture to send spam.
- Using an AI assistant to produce content that breaks these rules, to pose as a human, or to give medical, legal or financial advice as though it were authoritative.
- Accessing anyone else’s account; probing, scanning or testing our systems for weaknesses; bypassing limits or security; overloading the Services or collecting data from them by automated means.
- Reverse-engineering, decompiling or copying the Services, or reselling or sub-licensing them without our written permission.
- Using the Services in breach of sanctions or export laws, or helping anyone else do any of the above.
4. Artwork and printed hardware
We may refuse to print, engrave or programme — and may cancel an order for — anything that breaks the rules above, and in particular:
- other people’s or companies’ logos, names or trademarks that you are not authorised to use;
- the national flag, the State Emblem of India, or government names, logos or insignia, which Indian law protects (for example the State Emblem of India (Prohibition of Improper Use) Act, 2005 and the Emblems and Names (Prevention of Improper Use) Act, 1950);
- designs that imitate identity documents, currency, uniforms or official badges;
- professional titles, licences or registrations you are not entitled to use.
You are responsible for having the right to everything you ask us to print; see the Terms.
5. What we may do
If these rules are broken, or we reasonably believe they are, we may remove content or disable access to it, disable a Smart Profile, refuse or cancel artwork and orders, suspend or end an account, keep and hand over information to the authorities as the law requires, and report to law enforcement. We may act without notice where that is needed to protect people, to obey the law or to stop harm that is still going on; otherwise we tell you and give you a chance to respond. We may end the accounts of people who repeatedly infringe others’ rights. You can challenge a decision through the Grievance Redressal Policy.
6. Reporting content or infringement
To report unlawful or infringing content on a Smart Profile, email support@parichy.com with the subject “Content report” and include:
- your name and contact details;
- the web address of the profile or content;
- what is wrong and which law or right it breaks — for an infringement, identify the copyright work or trademark and how you own or represent it, and state that you believe in good faith that the use is not authorised by the owner, its agent or the law;
- a statement that the information in your report is accurate and, for an infringement, that you are the owner or authorised to act for the owner; and
- your name typed as a signature.
We acknowledge a report within 24 hours and act on valid reports within 15 days. Reports about intimate images or impersonation are handled within 24 hours, as the Grievance Redressal Policy sets out, and we act on a court order or government notice within 36 hours.
If we remove your content after a report you believe is mistaken, tell us why and we will look again; we may restore content where the report appears to be unfounded. False or malicious reports can lead to action against the person who made them.
7. Our role
Smart Profile content is published by our customers. We host it as an intermediary within the meaning of the Information Technology Act, 2000 and rely on the protection Section 79 gives where it applies. We do not review content before it goes live, and profile owners — not Procure Services — are responsible for what they publish. That does not reduce your own responsibility for what you publish.
